The "OBOROTO" mobile application/website is operated by Sakash Digital Aiding Pvt Ltd. Throughout the mobile application/website, the terms "we", "us", "our" and "OBOROTO" refer to Sakash Digital Aiding Pvt Ltd.

OBOROTO offers this mobile application/website, including all information, tools and services available from this mobile application/website to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Through our mobile application/website we sell discount coupons/membership with consent of our retailers, partners and marketers. We are not accountable for any goods or services provided by them.

By visiting our mobile application/website and/or purchasing coupons/membership from us, you engage in our "Service" and agree to be bound by these Terms of Service, including additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the mobile application/website, including browsers, vendors, customers, merchants and contributors of content.

Please read these Terms carefully before accessing or using our mobile application/website. If you do not agree to all the terms and conditions of this agreement, then you may not access the mobile application/website or use any services.

Any new features or tools added to the current platform shall also be subject to these Terms. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, access to the Service, or any contact on the mobile application/website through which the service is provided, without express written permission from us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We reserve the right at any time to modify or discontinue the Service, or any part or content thereof, without notice at any time.

We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Certain products or services may be available exclusively online through the mobile application/website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of partners or advertisers products that appear on the platform. We cannot guarantee that your mobile phone or computer monitor display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit quantities of products or services that we offer. Product descriptions and pricing are subject to change at any time without notice, at our sole discretion.

Any offer for any product or service made on this mobile application/website is void where prohibited. We do not warrant that the quality of products, services, information or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Billing and Account

We reserve the right to refuse any order you place with us. We may limit or cancel quantities purchased per person, household or order, including orders placed by or under the same customer account, the same credit coupons/membership, or orders using the same billing and/or shipping address.

If we make a change to or cancel an order, we may attempt to notify you by contacting the email, billing address or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our platform. You agree to promptly update your account and other information, including email address and credit card details, so we can complete transactions and contact you as needed.

Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control or input.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without warranties, representations or conditions of any kind and without endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the mobile application/website is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms on which tools are provided by relevant third-party providers.

We may also offer new services and/or features through the mobile application/website in the future. Such new features and/or services shall also be subject to these Terms.

User Comments

If you send submissions, creative ideas, suggestions, proposals, plans or other materials, whether online, by email, postal mail or otherwise, you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

We are under no obligation to maintain comments in confidence, pay compensation for comments, or respond to comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion is unlawful, offensive, threatening, defamatory, obscene, objectionable or violates any party intellectual property or these Terms.

You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary right. You are solely responsible for any comments you make and their accuracy.

Errors and Omissions

Occasionally there may be information on our mobile application/website or in the Service that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, transit times and availability.

We reserve the right to correct errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related mobile application/website is inaccurate at any time without prior notice, including after you have submitted your order.

We undertake no obligation to update, amend or clarify information in the Service or on any related mobile application/website, including pricing information, except as required by law.

In addition to other prohibitions set forth in these Terms, you are prohibited from using the mobile application/website or its content:

  • To solicit others to perform or participate in unlawful acts.
  • To violate international, federal, provincial, state or local laws and regulations.
  • To infringe upon or violate our intellectual property rights or the rights of others.
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate.
  • To submit false or misleading information.
  • To upload or transmit viruses or malicious code.
  • To collect or track the personal information of others.
  • To spam, phish, pharm, pretext, spider, crawl or scrape.
  • For any obscene or immoral purpose.
  • To interfere with or circumvent security features of the Service or related websites.

We reserve the right to terminate your use of the Service or any related mobile application/website for violating prohibited uses.

Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free, or that results obtained from the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered through the service are provided "as is" and "as available" for your use, except as expressly stated by us.

In no case shall OBOROTO, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for injury, loss, claim, or direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, revenue, savings, data or replacement costs, arising from your use of the service or any products procured using the service.

Because some states or jurisdictions do not allow exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend and hold harmless OBOROTO and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms, and such determination shall not affect the validity and enforceability of remaining provisions.

Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive termination of this agreement for all purposes.

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our mobile application/website.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services or any part thereof.

If these Terms are considered an offer, acceptance is expressly limited to these Terms.

Payment and Refund

There may be cases where OBOROTO is unable to accept your coupons, membership or subscription, or cancels the same due to reasons including technical errors or other reasons attributable to OBOROTO. In such cases, OBOROTO shall not charge a cancellation charge from you.

If the coupon, membership or subscription is cancelled after payment has been charged, you are eligible for a refund of the coupon, membership or subscription value or any part thereof, and the amount will be reversed to you.

All refunds shall be processed in the same manner as they are received, unless refunds have been provided in the form of credits, in which case the refund amount will reflect in your account.

No replacement, refund or other resolution will be provided once you subscribe to the coupon/membership. We request you to read and review the subscription in detail before subscribing to any OBOROTO discount coupons, membership or subscription.

Coupon/Membership

Hospitality: Hotel, Restaurants, Bakery

  • The coupons/membership is valid only at the property or store mentioned on the coupon/membership.
  • The coupons/membership is not valid on 25 Dec, 31 Dec, 01 Jan and 14 Feb.
  • Gift certificates cannot be clubbed with any other coupon and have to be redeemed per day per table.
  • Discount coupons cannot be combined with any other discount coupon or advertised special.
  • All plans are valid for dining only and based on a la carte.
  • The coupons/membership is valid for 365 days from the date of subscription.
  • Menu item purchase is necessary for validity and utilization of each coupon offer.
  • All discounts are based on published menu rates.
  • Destination, location, hotel, resort, restaurant, bakery, prices and menu items are subject to change without notice.
  • The membership is transferable but non-refundable.
  • No verbal commitment is accepted.
  • The coupon cannot be accepted through any social application and is not applicable on home delivery services.

Fashion: Garment, Footwear, Furnishing and Fashion Eye Wear

  • The membership coupon is valid only at the property mentioned on the coupon/membership.
  • The membership coupon is not valid on 25 Dec, 31 Dec, 01 Jan and 14 Feb.
  • Gift certificates cannot be clubbed with any other coupon and have to be redeemed per day per counter.
  • Discount coupons cannot be combined with any other discount coupon or advertised special.
  • The coupons/membership is valid for 365 days from the date of subscription.
  • Product purchase is necessary for validity and utilization of each coupon offer.
  • All discounts are based on price as per retail outlet.
  • Destination, location, prices and product standards are subject to change without notice.
  • The membership is transferable but non-refundable.
  • No verbal commitment is accepted.
  • The coupon cannot be accepted through any social application and is not applicable on home delivery services.

Health and Wellness: Salon, Spa, Health Club

  • The coupons/membership is valid only at the centre mentioned on the coupon/membership.
  • The coupons/membership is not valid on 25 Dec, 31 Dec, 01 Jan and 14 Feb.
  • Gift certificates cannot be clubbed with any other coupon and have to be redeemed per day per table.
  • Discount coupons cannot be combined with any other discount coupon or advertised special.
  • Offers cannot be clubbed with bridal packages unless specifically mentioned on the coupon/membership.
  • The coupons/membership is valid for 365 days from the date of subscription, but coupon validity is as per the date mentioned on the coupon.
  • Service purchase is necessary for validity and utilization of each coupon offer.
  • All discounts are based on published menu rates.
  • Destination, location, prices and menu services are subject to change without notice.
  • The membership is transferable but non-refundable.
  • No verbal commitment is accepted.
  • The coupon cannot be accepted through any social application and is not applicable on home services.
  • It is advisable to book an appointment before visiting the centre to avoid disappointment.
  • The centre holds appointments for 15 minutes after the booked time. In case of no-show within 15 minutes, the appointment shall be treated as cancelled.

Entertainment: Amusement Park, Movie Theatre, Game Zones

  • The coupons/membership is valid only at the property mentioned on the coupon/membership.
  • The coupons/membership is not valid on 25 Dec, 31 Dec, 01 Jan and 14 Feb.
  • Gift certificates cannot be clubbed with any other coupon and have to be redeemed per day per table/chair.
  • Discount coupons cannot be combined with any other discount coupon or advertised special.
  • The coupons/membership is valid for 365 days from the date of subscription.
  • Service purchase is necessary for validity and utilization of each coupon offer.
  • All discounts are based on published ticket prices.
  • Destination, location and prices are subject to change without notice.
  • The membership is transferable but non-refundable.
  • No verbal commitment is accepted.
  • The coupon cannot be accepted through any social application and is not applicable on home delivery services.

Partner Platform Use

Product and Services Offer

As a retailer/advertiser, you shall list product and service offers on the Platform in accordance with the policies incorporated by reference in the Terms of Use. You must be legally able to offer the listed products or services and must have all necessary licences and permits required for such offering.

You must ensure that listed items do not infringe upon intellectual property, trade secrets or other proprietary rights, publicity rights or privacy rights of third parties. Listings may include text descriptions, graphics, pictures or videos that describe your item for offer. All items must be listed in an appropriate category and kept in stock for successful fulfilment of services.

The listing description must not be misleading and must describe the actual condition of the product or service offer. OBOROTO reserves the right to delete such listings at its sole discretion.

Partner/Advertiser Declaration

You have carefully read the required mobile application/website fields on the OBOROTO Platform and have provided accurate information to the best of your knowledge. Any misrepresentation or omission of facts may justify refusal of payment, if any, or termination of your contract with OBOROTO.

You agree to provide OBOROTO and persons or entities affiliated to OBOROTO any information in your or your agent possession in considering you as a retailer/advertiser for its Platform.

You acknowledge that statements, information or documents provided by you do not create an expressed or implied contract with OBOROTO. You declare that information or documents provided by you are true and correct to the best of your knowledge.

You understand and agree that OBOROTO may institute and conduct a background check to verify information furnished by you, which may require disclosure to third parties. You authorize OBOROTO to carry out such background verification and agree to provide any information required in this regard.

You acknowledge and agree that providing false information may result in OBOROTO delisting you from the Platform and taking appropriate action. OBOROTO has the right to seek legal remedies, including indemnification and damages, for any loss caused due to false information provided by you.
